The user of the Site (the « User ») acknowledges having read the present legal notice (the « Conditions ») and undertakes to comply with them. The User acknowledges that he/she has been fully informed that his/her agreement to the content of the present Terms does not require a handwritten signature of this document, but results from his/her sole visit to the Site.

Obligations of the User

The User undertakes to use the Site in a lawful and non-fraudulent and/or malicious manner. The following are therefore prohibited: (i) any behaviour likely to damage the image, reputation and/or rights of Eclos Production or third parties; (ii) any act of malice or abuse against the Site or Eclos Production, or any act likely to be malicious or to constitute abuse. In this respect, the following may constitute such acts:
– Hacking into the Site or introducing malicious code, such as a virus, trojan horse, or any other device likely to harm the Site or any operating system;
– Extract data, photos, videos, illustrations, text or information from the Site;
– Send or store documents containing malicious code, files, scripts or agents that may harm the Site or any operating system;
– Affect the integrity and performance of the Site and its data;
– Gain or attempt to gain unauthorized access to the administration site, its associated systems or networks;

 

Copyright

The general structure, as well as the presentations, softwares, videos, texts, pictures (animated or not), sounds, know-how… and all other elements composing the Site are the exclusive property of Eclos Production or its partners.

Any total or partial representation of the Site, without the express authorization of the Site publication director, is prohibited and constitutes an infringement punishable by articles L. 335-2 et seq. of the French Intellectual Property Code.

The Conditions do not imply any transfer or disposal of any kind of intellectual property rights on the elements belonging to Eclos Production, or its assignees, such as presentations, sounds, videos, photographs, images, literary texts, artistic works, software, trademarks, graphic charters, logos for the benefit of the User. Any other use not expressly authorized in writing and in advance by Eclos Production is prohibited and constitutes an infringement.

 

Responsibility

Eclos Production endeavours to keep the Site accessible, free of charge, to anyone with access to the Internet and at any time, without being under any obligation to do so. Access to the Site may be interrupted without notice, in particular for maintenance, security or updating purposes. Eclos Production may not be held liable if, for any reason whatsoever, access to the Site is interrupted, regardless of the time and duration of the interruption.
All costs related to access to the Site, whether hardware, software or Internet access, are the sole responsibility of the User, who is solely responsible for the proper functioning of his computer equipment and the quality of his Internet access.
Eclos Production cannot guarantee the accuracy, precision, updating or exhaustiveness of the information made available on the Site, which is communicated « as is » and « according to the means » of Eclos Production. Consequently, Eclos Production declines all responsibility for any imprecision, inaccuracy or omission concerning the information available on the Site.
